Public comment on the draft Code of Claimants’ Rights (the Code) has commenced on the Engage Victoria website. 

 

About the Code  

 

The Code is one of several legislative amendments introduced under the Workplace Injury Rehabilitation and Compensation Amendment Act 2025 to improve the experience of claimants accessing Victoria’s WorkCover scheme. It also responds to a recommendation from the Victorian Government’s 2020 Independent Review into Complex Workers’ Compensation Claims Management. 

     

The purpose of the Code is to ensure claimants are treated with dignity and respect, and to provide clear service standards for WorkSafe, its agents and self-insurers.  

 

The draft Code sets out the:  

 

• rights of claimants    

• duties and obligations of WorkSafe, its agents (including authorised agents, independent medical examiners, occupational rehabilitation providers and private investigators) and self-insurers    

• complaints process if there is a breach   

• remedies that apply if a complaint is substantiated.    

Participating in public comment

 

The draft Code is open for submissions on the Engage Victoria website from Wednesday 29 April 2026 until Wednesday 27 May 2026 at www.engage.vic.gov.au/code-of-claimants-rights  

WorkSafe will review and consider all submissions received during public comment and make changes to the draft Code to reflect the feedback received, where appropriate, before providing it to the Minister for WorkSafe and TAC for approval.
