New incident notification requirements for plant and equipment.

Amendments were made to the Occupational Health and Safety Regulations 2017 (OH&S Regulations) and the Equipment Public Safety Regulations 2017 (EPS Regulations). Regulations that prescribe new incident notification requirements for plant and equipment were made on Tuesday 9 April 2024.
The regulations will commence on Monday 01 July 2024, to allow time for duty holders to be ready to meet their obligations.
Background
Following changes to the Workplace Safety Legislation, the then Minister authorised WorkSafe to review notification duties and recommend reforms in the Occupational Health and Safety (OHS) Act. WorkSafe subsequently amended the OHS and EPS Regulations to improve health and safety outcomes.
What will this mean for duty holders?
From commencement, there will be new types of plant and equipment that duty holders will need to notify WorkSafe about if they are involved in an incident of collapse, overturn, failure, malfunction, or damage exposing a person to serious risk to their health or safety.
Importantly, the list of prescribed plant has been broadened and includes equipment in common use across a wide variety of industries such as tractors, forklifts, and excavation machinery.
